CarInspector.io – Terms of Service

These Terms of Service (the "Terms"), together with our Privacy Policy and any supplemental rules or policies referenced herein (collectively, the "Agreement"), form a legally binding contract between you ("you" or "User") and Auto Inspector LLC dba CarInspector.io, a Texas limited liability company ("CarInspector.io," "Company," "we," or "us"). PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING ANY OF THE SERVICES (DEFINED BELOW) YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract in your jurisdiction to use the Services. The Services are not directed to, and may not be used by, anyone under 18 years of age. By creating an account or booking an inspection you represent and warrant that you meet these requirements.

2. The Services

CarInspector.io operates a technology platform (the "Platform") accessible via our website, mobile web, and any mobile applications we may offer (collectively, the "Services"). The Platform enables Users to schedule and pay for pre‑purchase vehicle inspections and related digital deliverables (inspection reports, AI‑generated cost estimates, and VIN reports). The Services do not include mechanical repair, maintenance, towing, or smog/state inspections.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without liability to you.

3. Limited License

Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your personal, non‑commercial use. We reserve all rights not expressly granted herein.

3.1 Restrictions

You shall not (a) reproduce, sublicense, sell, or exploit the Services; (b) reverse engineer or decompile any part of the Platform; (c) remove proprietary notices; (d) interfere with or circumvent security features; or (e) access the Services for competitive benchmarking or data mining purposes.

4. Ownership

All content, software, and other components of the Services are the property of CarInspector.io or its licensors and are protected by copyright, trademark, and other laws. Inspection reports remain our copyrighted works; you receive a personal, non‑transferable license to use the PDF report for your own evaluation of the vehicle. You may not alter, edit, or misrepresent any report.

5. User Accounts

To book an inspection you must create an account and provide accurate, current, and complete information, including a valid payment method. You are responsible for all activity conducted through your account and must safeguard your credentials. We may suspend or terminate your account for any breach of these Terms or suspected fraud.

6. Booking, Cancellation & Refund Policy

ALL SALES ARE FINAL. Once an inspection is booked and paid for, fees are non‑refundable.

• If the vehicle is sold or otherwise unavailable before the inspection occurs, the amount paid will be retained on your account as credit toward a future inspection.
• If CarInspector.io, in its sole discretion, determines that a job is unserviceable (e.g., unsafe location, inspector unavailable), we will refund the fees related to the unserviceable portion.
• Rescheduling is permitted through the Platform. Additional travel or wait‑time fees may apply at our discretion.

There are no cash refunds for customer‑initiated cancellations or schedule changes.

7. Payments & Chargebacks

Payments are processed via Stripe. CarInspector.io acts as the limited payment collection agent for independent inspectors and collects all fees on their behalf. We centrally absorb or contest chargebacks; your sole remedy for any billing dispute is to contact us at info@carinspector.io within 10 days of the charge.

8. Promo Codes & Gift Cards

We may issue promotional codes or gift cards (collectively "Promo Codes") redeemable only through the Platform. Promo Codes: (a) are not redeemable for cash; (b) may not be resold; (c) may expire; and (d) are subject to any additional terms we publish.

9. No Warranty; Inspection Disclaimer

THE SERVICES, REPORTS, AND ANY INFORMATION PROVIDED ARE OFFERED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS. CARINSPECTOR.IO MAKES NO WARRANTY—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON‑INFRINGEMENT.

We do not guarantee that an inspection will identify every existing or potential defect; inspectors do not disassemble vehicles and rely on visual cues and limited diagnostic tools. You alone are responsible for any purchase decision and for all future repair or maintenance costs.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARINSPECTOR.IO'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE INSPECTION GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF VALUE, LOST PROFITS, OR PROPERTY DAMAGE.

11. Indemnification

You agree to indemnify, defend, and hold harmless CarInspector.io and its officers, directors, employees, and agents from any claims, damages, or expenses arising out of (a) your breach of this Agreement, (b) your misuse of the Services, or (c) your violation of any law or third‑party rights.

12. Dispute Resolution & Governing Law

12.1 Governing Law

This Agreement is governed by the laws of the State of Texas, without regard‑of‑laws principles.

12.2 Arbitration & Class‑Action Waiver

Any dispute arising out of or relating to the Services or this Agreement shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration will be conducted in Austin, Texas. You and CarInspector.io waive the right to a jury trial and to participate in class actions. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual‑property rights.

13. Termination

We may suspend or terminate your access to the Services at any time for any reason. You may terminate this Agreement by closing your account and ceasing all use of the Services, provided no outstanding inspections remain.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Platform. Continued use of the Services after such posting constitutes your acceptance of the revised Terms.

15. Notice

Legal notices must be sent by email to info@carinspector.io with the subject line "LEGAL NOTICE." Notices are deemed received 24 hours after the email is sent.

16. General Provisions

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction. If any provision is held unenforceable, the remaining provisions will remain in effect. No waiver is effective unless in writing.
